Obtaining Investigative Orders to support a Financial Investigation, 4 December 2024

 

The Investigator is hosting this ‘must attend’ workshop that examines Investigative Orders, their role in financial crime investigations and how to successfully obtain the orders.

It is the latest in our successful series of CPD workshops that cover contemporary best practice around financial crime investigations

Investigative Orders are a powerful and effective tool that can be used to obtain key material to support a financial crime investigation.

 

However, many investigators lack confidence in their use and as a result they are often inappropriately or under used.

Our workshop aims to provide operational best practice in respect of investigative orders obtained under both the Police and Criminal Evidence Act 1984 (PACE) and the Proceeds of Crime Act 2002 (POCA) to help build confidence and encourage all those involved in financial crime investigations to feel proficient in using the orders as a routine part of their work.

In relation to PACE Investigative Orders we will be considering Production Orders and Search Warrants.

We will also be considering all five investigative orders available under Part Eight of POCA, which are:

  • Production Orders

  • Account Monitoring Orders

  • Customer Information Orders

  • Search and Seizure Warrants; and

  • Disclosure Orders

 

Who should attend

The workshop is aimed at for all investigators working in a financial investigation role. It is also suitable for Financial Investigators who want to refresh and revise existing skills.

Our expert

The workshop will be led by Nicola Fairbairn who recently retired from the City of London Police after 30 years’ service of which over 22 years were spent in the Economic Crime arena, primarily as a Financial Investigator.  She now works as a Specialist Economic Crime Trainer and Consultant.

Workshop content

Session One: An Introduction to investigative orders used in Economic Crime Investigations including an overview of the three PACE and five POCA orders available to support criminal investigations.

Session Two: Intelligence or Evidence? The practicalities of deciding which is the best way of obtaining material.

Session Three: Pre-Application considerations, pre-order enquiries and required preparation.

Session Four: Obtaining the order: drafting the application and subsequent considerations.

Question and discussion: There will be the opportunity for delegates to ask questions and share their experiences with their peers.
